Our review of the FBI’s use of NSLs in 2006 found a continued upward trend in the use of NSLs, with 49,425 NSL requests issued in 2006, a 4.7 percent increase from the previous year. For the 4-year period 2003 – 2006, the FBI issued more than 192,000 NSL requests.

A US District Court Judge Susan Illston in San Francisco has ordered the FBI to stop its "pervasive" use of National Security letters to snoop on phone and email records, ruling that the widespread tactic was unconstitutional. Illston said evidence indicated that tens of thousands of NSLs are sent out every year, and that 97 percent of them are fettered with the provision that recipients never mention the requests.

"This pervasive use of nondisclosure orders, coupled with the government's failure to demonstrate that a blanket prohibition on recipients' ability to disclose the mere fact of receipt of an NSL is necessary to serve the compelling need of national security, creates too large a danger that speech is being unnecessarily restricted," Illston said in her written decision. "The government's gags have truncated the public debate on these controversial surveillance tools." NSLs are used to get companies to secretly turn over private information such as websites visited, phone records, email addresses, and financial data.

Google early this month made the unusual move of adding NSLs to its transparency report about requests by governments for data about users of the Internet giant's various online products and services. The requests affected between 1,000 and 1,999 accounts, except in 2010, when the range was 2,000 to 2,999 accounts. Despite a lack of exact data, "Google has helped to at least shed some limited light on the ways in which the US government uses these secretive demands for data about users,"

"While we continue to be in the dark about the full extent of how the law is being applied, this new data allays fears that NSLs are being used for sweeping access to large numbers of user accounts -- at Google, at least."

Public records have documented the FBI's "systemic abuse" of the power.

The U.S. Department of Homeland Security has customized its Predator drones, originally built for overseas military operations, to carry out at-home surveillance tasks that have civil libertarians worried: identifying civilians carrying guns and tracking their cell phones, government documents show.

No doubt, this involves an Arrowhead upgrade for the drones. I worked at the component level on the now-declassified project to upgrade power throughput capabilities. Microwave (radar) was integrated to Apache helicopter vision systems to allow detection of ambient temperature metallic wires, (guy-wires) which are flight hazards. Metallic objects are visible through your clothes, but not inside a metallic pouch or lunch-pail. ‘Heads Up’, fellow targets, since these devices are now being trained, (unlawfully) on USA citizens. Sorry about that. I had friends on those helicopters, on legitimate military missions at the time.

Offices and homes do not generally benefit from constant GPS positioning of desktops, towers and laptops. Consumers and businesses generally know the location of their computers and rooms. But now every new computer, user, office and home is instantly available for government and commercial surveillance. This is an a priori presumption of guilt, unworthy of a republic.

The Windows 8 operating system opens to the store. This is not where businesses and families generally CHOOSE to begin their day.

The ‘Password Recovery’ questions are increasingly … personal and familial. This is chillingly reminiscent of the EARLY tactics of the 3rd Reich. Every question asked provides more personal background information, than a search warrant would normally allow.

Windows 8 does not allow easy access to mission critical websites. And vertical navigation within those websites is a disaster.

Service Pack 1 better be ready VERY soon; because Windows 8 is a total disaster, out of the box.

It is not presently possible to navigate the webpages of Industry, governments and government contractors using Windows 8. The security settings can be set as low as possible. Still the gawdamn software does not allow the routine actions of object oriented programing.

Al-Qaeda's list of 22 tips for dodging drone attacks - including at least one believed to originate with Osama bin Laden - has been found hidden inside a manila envelope in a building abandoned by Islamists in Mali.

Found by the Associated Press in a building in Timbuktu, the ancient city occupied by Islamists last year, the document is believed to have been abandoned as extremists fled a French military intervention last month.

A confidential Justice Department memo concludes that the U.S. government can order the killing of American citizens if they are believed to be “senior operational leaders” of al-Qaida or “an associated force” -- even if there is no intelligence indicating they are engaged in an active plot to attack the U.S.

It was disturbing to see the twisted logic of the administration’s lawyers laid out in black and white. It had the air of a legal justification written after the fact for a policy decision that had already been made, and it brought back unwelcome memories of memos written for President George W. Bush to justify illegal wiretapping, indefinite detention, kidnapping, abuse and torture.

The document, coyly describes another, classified document that actually provided the legal justification for ordering the killing of American citizens. That document still has not been provided to Congress, despite repeated demands from lawmakers. It takes the position that the only “oversight” needed for such a decision resides within the executive branch, and there is no need to explain the judgment to Congress, the courts or the public — or, indeed, to even acknowledge that the killing took place.

The paper argues that judges and Congress don’t have the right to rule on or interfere with decisions made in the heat of combat. Some officials also draw a parallel to police officers who use violence to protect the innocent. Even in wartime, there are many ways to review commanders’ and soldiers’ decisions, and while courts-martial are internal to the military, their verdicts are subject to appeal to a civilian judge. When a police officer so much as discharges his weapon, it triggers a great deal of review, based on rules that are known to everyone.

The white paper “is a confusing blend of self-defense and law of war concepts and doesn’t clearly explain whether there is a different standard for killing a senior Al Qaeda leader depending on whether he is a citizen,” said Kate Martin, director of the Center for National Security Studies. “Its due process analysis is especially weak.” The memo could and should have been released months ago. The administration could and should have provided a select number of lawmakers with the specifics on the killing of Mr. Awlaki and his son.

Web Activist’s Family Blames MIT, Prosecutors in Death

The family of Aaron Swartz, a computer programmer, entrepreneur and activist who died last week, blamed his suicide on the Massachusetts Institute of Technology and the U.S. prosecutors who accused him of crimes including wire and computer fraud. Swartz, 26, died from suicide by hanging, according to the New York Medical Examiner’s Office. Swartz was indicted on federal charges of gaining illegal access to JSTOR, a subscription-only service for distributing scientific and literary journals, and downloading most of the library.

As a teenager, Swartz helped create a technology called Really Simple Syndication, or RSS, which lets Web users gain access to online information. “Aaron’s death is not simply a personal tragedy,” his family wrote in a statement. “It is the product of a criminal justice system rife with intimidation and prosecutorial overreach. Decisions made by officials in the Massachusetts U.S. Attorney’s office and at MIT contributed to his death.”

“The U.S. Attorney’s office pursued an exceptionally harsh array of charges, carrying potentially over 30 years in prison, to punish an alleged crime that had no victims,” Swartz’s family wrote. “Meanwhile, unlike JSTOR, MIT refused to stand up for Aaron and its own community’s most cherished principles.” Representatives from the U.S. Attorney in Massachusetts declined to comment.

A woman hiding in her attic with children shot an intruder multiple times before fleeing to safety Friday. He said she took her 9-year-old twins to a crawlspace before the man broke in using a crowbar. But the man eventually found the family. "The perpetrator opens that door. Of course, at that time he's staring at her, her two children and a .38 revolver," Chapman told Channel 2’s Kerry Kavanaugh. The woman then shot him five times, but he survived, Chapman said. He said the woman ran out of bullets but threatened to shoot the intruder if he moved. "She's standing over him, and she realizes she's fired all six rounds. And the guy's telling her to quit shooting," Chapman said.

Deputies arrested 32-year-old Atlanta resident Paul Slater in connection with the crime. Chapman said they found him on the ground saying, "Help me. I'm close to dying." Slater was taken to Gwinnett Medical Center for treatment. Chapman said Slater was shot in the face and neck. In February, Slater was arrested on simple battery charges, according to the Gwinnett County Sheriff's Office. He has been arrested six other times in the county since 2008. Channel 2’s Amy Napier Viteri learned from Chapman late Friday night that Slater has been placed on a ventilator and suffers from punctured lungs, a punctured liver and a punctured stomach. He said if Slater survives the night, doctors will try to operate in the morning to repair the damage. Chapman said Slater has four exit wounds. Slater is currently being charged with burglary.

DALLAS (January 30, 2013)—A Texas Department of Public Safety trooper faces dismissal after an investigation of her videotaped body cavity search of two women along a Dallas-area highway. Agency director Steve McCraw has made a preliminary determination to terminate Trooper Kelly Helleson, Department of Public Safety spokesman Tom Vinger said. The Dallas County Grand Jury is expected to indict Trooper Kelly Helleson in the next couple of weeks. She had been on suspended leave since the investigation of the July 2012 stop began. The DPS Director, Steve McGraw, has decided to relieve her of her duties as a Texas Trooper permanently. Helleson better hire a good criminal defense attorney!

Trooper Helleson allegedly violated both cavities in their pelvic regions violently and without cause. The body cavity searches of both women yielded no drugs, weapons, or contraband of any kind. The driver was given a ticket and they were sent on their way. It will be interesting to see if criminal charges are filed against Helleson and if so how severe they are. The alleged victims in this case are calling it rape. I guess we will have to wait and see. One thing’s for sure though; she can’t talk her way out of video footage.
